Planning commission recommends denial of Semnani rezone request after resident opposition

The Planning & Zoning Commission on Aug. 14 recommended denial of Signature Homes’ rezoning request for parcels at 58 W 7500 S and 7444 S State St (four parcels totaling 1.66 acres) by a 4–1 vote. Commissioner Dustin Snow moved the denial; Vice Chair Robyn Anderson seconded.

Developer John Semnani said the site is in the Middle State Street Opportunity Area and argued higher density mixed‑use would replace blighted structures and boost nearby commercial activity. He said the rezoning aligns with the Midvale General Plan’s goals and would allow redevelopment of an underutilized block.

Several residents and written commenters opposed the rezone, raising issues including parking and traffic impacts, potential displacement of long‑term renters, loss of mountain views, and an easement that one neighbor said, if blocked, would landlock his property. Mrs. Butler submitted a petition and Mr. Peters said he would lose access if certain easement areas were obstructed. Senior Planner Elizabeth Arnold said the easement must be acknowledged and maintained and clarified height and setback rules; Wendelin Knobloch noted older condominium developments in the area already reflect multi‑family uses.

Commissioners expressed concern about compatibility with nearby single‑family homes and the unresolved easement access issue. Commissioner Liedtke attempted a motion to approve but it failed for lack of a second. Commissioner Snow’s motion to deny passed 4–1 (Liedtke opposed). The commission’s recommendation goes to City Council for a final decision.
