Baldwin City Council approves phased rent increases for two downtown leases

Baldwin City Council voted June 2 to approve revised lease terms for two city-owned downtown properties, moving both toward a modified triple-net structure with staged base-rent increases.
Russ, a city staff member, told the council the appraisal for the bullpen put market base rent at $1,250. Councilmembers debated a range of approaches — a flat percentage discount off appraised values, a $50-per-year stair-step, or annual percentage raises — before approving the approach discussed at the meeting. "If you look in the packet for the bullpen, it's on page 3 of 57. It says that the market rent should be $1,250," Russ said during the discussion.
The council approved the bullpen lease as proposed during the meeting and separately approved a one-year lease for the EDC building that applies the same maintenance and ramping language. A councilmember moved "to approve the lease of the bullpen building, as proposed tonight during the council meeting," and the motion passed by voice vote.
The approved schedule for the bullpen's base rent moves from $1,000 in year 1 to $1,250 by year 5, with property tax and other monthly additions discussed separately. Councilmembers said the phased approach is intended to avoid forcing a sharp rent increase on existing tenants while still moving the city closer to market rates.
The council directed staff to draft the final lease documents reflecting the vote. The motion passed among the attending councilmembers and no recorded roll-call opposition was entered at the time of the voice vote. The council also directed staff to apply the same discount/step logic to the EDC building where appropriate.
The council noted that future contracts executed after July 1 will be subject to a new state house bill the city attorney referenced, which affects how the city may handle property-tax waivers in leases.
