Council recognizes 2023 deferment agreement for Bragger subdivision, holds further infrastructure decisions until planning commission acts

City staff briefed the council that the existing deferral agreement referenced only two lots and was not signed by an authorized city representative, while an applicant had submitted a subdivision amendment proposing a third lot. Staff identified conflicting provisions in the agreement (a 60-day completion requirement after notice versus language barring new building permits until improvements are installed) and asked council for direction on how to proceed.
After discussion the council voted to recognize the 05/04/2023 deferral agreement as valid for the two recorded lots but directed staff to withhold decisions about when deferred curb, gutter and sidewalk improvements are required, and whether further building permits should be issued, until the planning commission completes review of the submitted subdivision amendment. For the record, the minutes include that a council member abstained from the recognition vote.
