Commission adds District C, approves first reading of underground parking ordinance

The Commission on Nov. 17 approved Ordinance 0-8-25 on first reading, clarifying which zoning districts may allow underground/depressed parking.
Town Attorney Keith Davis explained the ordinance changes underground/depressed parking authorization from "all districts" to Districts B & D. Commissioners asked why other districts were removed and whether owners should be able to seek alternatives. Attorney Davis noted FEMA-related concerns and said an owner could elect the added expense at their own risk; he also said the Commission could add District C pending verification with the engineer. Commissioner Roby DeReuil moved to adopt Ordinance 0-8-25 with the addition of District C on first reading; Commissioner Steven Smith seconded and the motion passed 5-0.
Public comment included Mark Ward noting at P&Z he understood FEMA requirements would prohibit depressed parking because frangible walls might be required; Commissioners discussed design options for releasing flood water from depressed areas.
