Donald Planning Commission allows bond credit for pathway, defers construction on Butteville Road

The Donald Planning Commission on Sept. 25, 2025 voted 5-0 to amend a prior Site Development Review requirement that would have required the applicant to construct a pedestrian pathway through Tract C from the subject property south to Oak Street.
City Planner Holly Byram told the commission this was not a public hearing because “this was not a public hearing due to SB 1537 in 2024, which made the Site Development Review a limited land use process,” and reviewed the origin of Condition #18, a connectivity requirement that traces to recommendations from 2015 and a later land use decision.
Byram presented five options on how to treat Condition #18, including upholding the original requirement, applying the bond value to future improvements on Butteville Road, striking the pathway requirement, tabling the item, or deferring construction until full buildout. Property owner Jim Morse said the parcel’s original industrial-park concept changed and is now a single fenced tax lot; he raised safety concerns about an open pedestrian gate at the property. Neighboring business owner Andrew Ghiglia told commissioners the pathway would create safety and security risks because hazardous activities occur at his site and he wants to maintain controlled access via a fire gate.
After discussion that the site circumstances had changed since the original approval and that the safety concerns were valid, Commissioner Cammi Hungate moved (seconded by Commissioner Ben Rose) to uphold the findings and conditions of SDR 2022-02 with a revision to Condition #18: the applicant may apply the value of the Tract C Pathway bond to future pedestrian improvements on Butteville Rd NE, and the actual construction of Butteville Road pedestrian improvements shall be deferred by a recorded Construction Deferral and Non-Remonstrance Agreement. The deferral is to be triggered by either a governmental pedestrian improvement project on the missing Butteville segment between Oak Street NE and the Donald Industrial Park or by a private development on a property abutting that segment. The motion carried, vote 5-0-0.
The commission’s action leaves the bond funds available to be applied to the missing Butteville improvements when the specified triggers occur, rather than requiring immediate construction through Tract C. The meeting record shows no further conditions attached and no separate amendments were adopted. The commission adjourned at 8:32 p.m.
