The commission recommended a text amendment to Chapter 405 of the subdivision regulations to remove references that limited condominium plats to multifamily buildings and bring the city code into alignment with state statute.
Carlos Trejo explained that state law prevents municipalities from placing zoning or building-code restrictions that would effectively bar property from being converted into condominium ownership and recommended removing limiting language. "State statute says that cities and municipalities cannot put in with their zoning code... restrictions from any property becoming condo type of property," Trejo said, describing the legal inconsistency and staff's recommendation.
Commissioners noted the city attorney had advised the change; the commission voted unanimously to forward the amendment to City Council for public hearing on Aug. 25. Staff also noted existing commission and council review steps that ensure indentures and fire-safety measures remain part of the condominium-plat review process.
