Presenters told the hearing the RNG project requires a Title 5 air permit renewal and a permit modification that together triggered New Jersey's EJ process.
John Bonacore and the technical team cited a modification submitted under BOP 25001 on June 26, 2025 and a Title 5 renewal filed on January 9 (program interest 41,417,002 under Title 5 permit BOP 24004). They said NJDEP had not issued the renewal and that the modification meets the Title 5 definition of a significant modification.
The project was described as not requiring updates to other permits and presenters listed existing authorizations: NPDES discharge permits, land‑use and solid‑waste permits, Toxic Catastrophe Prevention Act registration, and small‑quantity hazardous waste generator status. The team said they would assemble and respond to written comments received during the public comment period for NJDEP review.
