The Metropolitan Area Planning Commission on July 20, 2026, approved a lot-line adjustment for properties addressed 4614 and 4620 North 4th Street, with finalization contingent on variances from the Board of Adjustments and a recorded private sewer easement. Staff described the request as essentially a lot-line adjustment rather than the creation of new parcels.
"They're just adjusting this line, moving it over about 19.6 feet to the east," said Joaquin Porter, Community Development Director, during the staff presentation. Porter told commissioners the subject lots are currently nonconforming and that the change in lot size triggers the street-frontage requirement under code section "11 73 b," which staff described as a 100-foot frontage standard. Porter recommended approval only if the Board of Adjustments grants the requested variances to reduce the frontage requirement for both properties.
Applicant Richard *****, the owner of both properties, told the commission the parcels each have separate utilities and that they had been deeded separately in the past. "They each have their own utilities," he said, supporting staff's plan to file a private sewer easement because the main runs through the rear of the properties. The applicant confirmed he purchased both properties on a single deed and supported the easement for protection of the front property owner.
A commissioner moved to approve the lot-line adjustment conditioned on the BOA variances and the easement; the motion was seconded by Commissioner David Henneke and carried with members verbally indicating "aye." The transcript does not record an individual roll-call vote; commissioners approved the staff recommendation and directed the applicant to pursue the required BOA variances and file the private sewer easement as part of final processing.
