Counsel to send letters after disagreement on who maintains road west of U.S. 41
Summary
District Counsel reported the Village of Estero says it does not need to maintain the road west of U.S. 41 to the Clubhouse; District Counsel Tony Pires said he believes the County is responsible and will send letters to the Village and County counsel asserting ownership based on Johnson Engineering documents.
During staff reports, Lenore Brakefield of Woodward Pires & Lombardo told the board that the Village of Estero’s position is it does not need to maintain the road west of U.S. 41 to the Clubhouse. District Counsel Tony Pires said he believes the County, not the Village, is responsible for that segment and that he will send letters to both the Village and the County’s counsel asserting that the Village owns the road based on engineering documents provided earlier.
Mr. Shane Willis said he had emailed Johnson Engineering documents to Mr. Pires on November 20, 2024 to support the district’s position. No board action was taken at the meeting beyond the direction for counsel to send letters to the two jurisdictions.
