The Monroe County Board of Commissioners voted July 23 to approve Ordinance 2026‑23, rezoning the property at 3695 West State Road 45 from limited business to general business to allow uses including a fast‑casual restaurant.
Planner Ray Divaya presented the petition and explained the change would increase permitted uses from 60 to 85 under county zoning. Divaya said the petitioner plans to apply for a conditional accessory drive‑through if the rezone is approved and that INDOT will not review driveway permits until the rezone is finalized. "The petition site contains two access points via existing driveway entrances along State Road 45, which are maintained by the Indiana Department of Transportation," Divaya said. Staff also noted stormwater requirements (reference to Chapter 7.61) and that public utilities and bus stops serve the site. No public opposition appeared; the board approved the rezone by voice vote.
Commissioners and planning staff clarified that a sidewalk will be required at site plan review but noted it may be an INDOT permitting issue depending on jurisdiction. Planning director Nestor Jelen confirmed the sidewalk issue and said if INDOT will not require it, the petitioner would need a variance. The board recorded the motion and approved the ordinance.
