Fallsburg authorizes short-term repairs to Davos Pointe roadway; owners given compliance deadline

The Town of Fallsburg board on July 7 set a compliance date of July 26, 2026 for repair of the driveway/roadway at Davos Pointe Condominium Association (SBL 57-1-13.21) and authorized the town’s Department of Public Works to make necessary repairs and invoice the property owner if the work is not completed by that date.
A clerk read a notice of complaint and hearing dated July 16, 2026 alleging property-maintenance violations under town code chapter 218 and explaining the town’s authority to order correction and recover costs. Board members described the road as severely deteriorated and said residents had begun driving on grass to avoid damaged sections; one speaker said the owner placed boulders to block that detour. Officials said the town’s immediate plan is pothole filling and patching to restore safe passage; a full base reconstruction would be far more expensive.
The board discussed that Davos (the property owner) holds fee title while the condo association has an easement/right of way; town counsel noted rights-of-way can make the owners’ obligations complex, but the town’s concern is health, safety and welfare. Town officials said whoever received the notice is responsible for the repair order; if costs are unpaid, they may be levied as an assessment against the property.
