The Planning & Zoning Commission recommended that City Council approve a set of text amendments to clarify the duplex overlay (Section 17-7-1.13), revise Section 17-7-1.3(A)(1) to remove a requirement that a structure be preexisting before subdivision, and amend the duplex definition to allow individual ownership of each side.
Staff framed the changes as primarily clarifying edits to reduce redundant or confusing code language. During discussion, Commissioner Dustin Snow asked whether a developer could sign initial subdivision documents before closing; Senior Planner Elizabeth Arnold stated, "the current owner would sign and then the future owner would need to be listed on the documents in order to separate the property." Deputy City Attorney Daniel Van Beuge reminded the Commission this is a legislative recommendation to Council.
Commissioner Candace Tippetts moved to recommend approval as provided in the staff attachments, citing the findings in the staff report; Commissioner Snow seconded and the motion passed unanimously. The Commission’s recommendation will be forwarded to City Council for final action.
