The New Smyrna Beach Planning & Zoning Board did not recommend rezoning 1300 South Atlantic Avenue from B2 (neighborhood business) to R3A (single‑family/ two‑family residential) after a 3–3 tie.
The applicant presented plans for six to eight single‑family homes with two‑car garages and rooftop decks. Architect Jay Pendergast showed renderings and said the designs could provide additional landscaping to buffer the adjacent Walgreens parcel. "They all have 2 car garages... they're designed as single family homes," Pendergast said while describing floor plans and the possible reduction from eight to six units if buffering requirements reduce buildable lots.
Several nearby residents spoke in favor of replacing the vacant bank/parking‑garage proposal with smaller single‑family homes. Richard Flanagan, who identified himself as owner/operator of Boston's Fish House near the corner, said the block is "definitely residential" and supported the applicant's lower‑intensity proposal. Other public commenters raised concerns about drainage and emergency access; Sue Trask said, "I would be very concerned now that we're going to lose that big open space and we may start flooding."
A motion to recommend rezoning was made and seconded; the roll call returned three votes in favor and three opposed, so the motion failed on a tie and no recommendation will be forwarded to the commission.
