Commission adopts two right-of-way vacations at airport and Cotton Shed subdivision

The New Smyrna Beach commission voted to adopt two ordinances vacating unopened platted rights-of-way.
Senior Planner Jake Baker described Ordinance 77-25 as a cleanup of three small unopened rights-of-way on airport property. He told commissioners the roads are unused and that utilities will retain easements to maintain a 14-inch force main and a 12-inch water main. "These roads, aren't really used for anything in there... they might have to just redesign something else," Baker said, and noted planning and zoning recommended adoption 5-0.
For Ordinance 78-25 Baker said the applicant, Aubrey Cummings Jr., claimed a prior undocumented vacation and the request would distribute a 10,400-square-foot right-of-way to adjoining property owners. Planning and zoning recommended approval and no public speakers came forward at either hearing. Both ordinances passed on roll call votes with the commissioners present voting yes.
City staff said the vacations will not remove utility maintenance rights and that the airport-related vacation preserves easements for existing water and sewer mains. No amendments were made on the floor.
