Nephi City Planner Shauna Talbot presented proposed changes to Section 11.6.12(5)(h)(1) of the development code on May 13 to establish maximum noise levels for industrial and commercial zones, including data centers within the new ID4 zone. Talbot explained the maximum allowable level "is to be measured at the property line," and described options for verification including city testing, owner-provided special inspections at permitting, and post‑operation testing if concerns arise.
Talbot summarized example measurements taken at an Eagle Mountain data center, industrial parks and commercial areas. Commissioners discussed technical and enforcement details: measuring at multiple property boundaries, conducting random or unannounced tests, requiring third-party testing to resolve discrepancies, and adding contractual penalties beyond the current Class C misdemeanor. The commission thanked staff for example testing and discussed the possibility of requiring a sound study and mitigation if levels exceeded allowed limits.
After discussion, Chairman Cory Thomson moved to continue the item to the next meeting so amendments and updates to the ordinance can be considered; Commissioner Fran Petersen seconded. The motion passed unanimously with those present (4-0). Staff will return with proposed ordinance revisions and recommended measurement/mitigation protocols at a future meeting.
