Livingston planner says city on track to meet state housing-element requirements after rezones

Miguel Galvez, contract city planner, told the Livingston City Council that the city has received a letter from the California Department of Housing and Community Development (HCD) indicating the housing element will be in compliance once the identified housing sites are rezoned and the housing element is updated.
"Once the housing sites are rezoned and the housing element is updated, then the city will be in full compliance with state housing law," Galvez said. He told the council staff identified two replacement sites after community opposition required removal of earlier candidate sites.
Galvez said the planning commission will consider the rezones and general-plan amendments at its regular meeting on August 11. Staff plans to bring the item to the City Council for first reading on August 18 and second reading on September 1. Council members noted compliance is required to be eligible for many state grants and funding opportunities.
The planner also reminded the council that noncompliance can carry penalties: Galvez referenced recent state action involving another city, saying the attorney general had sued Turlock over a noncompliant housing element. Council members responded that the city's timeline should allow it to compete for forthcoming grant opportunities, including an anticipated CDBG NOFA in the fall.
Next step: the planning commission hearing on August 11; council readings in August and September.
