Health Agent Drew Belsky reported that a post-construction file review for 13 Bernard Circle revealed the primary cesspool chamber lies within 10 feet of a newly converted foundation, creating risk that septage could contact the structure. Belsky recommended replacing the primary cesspool chamber with a watertight septic tank and using the secondary cesspool as a leaching pit to meet applicable setback regulations.
The Board agreed the upgrade requirement was a reasonable application of cesspool-upgrade rules triggered by the building modification and directed staff to notify the property owner.
