Council member Lukey asks whether federal land purchase could put detention facility outside county law

Speaking remotely, Council Member Lukey said recent press reports about federal land purchases for a potential holding facility in Washington County were "frightening" and asked whether land purchased by the federal government could be deemed a federal enclave and therefore not subject to county law. "If they if the federal government purchased the land from a private landowner, is it then deemed a federal enclave so it is not part of that county's land or subject to that county's laws? Could you comment on that?" he asked.
Ms. Wellens, council staff, responded that the county should examine any such situation "case by case" with the County Attorney's Office to determine what options, if any, exist. "In general, I would say... we can't prevent the federal government from acquiring land from a private entity," she said, adding that the county's authority would depend on the specific facts of any proposed federal facility.
The exchange was framed as a legal and procedural question; staff did not offer a definitive legal ruling in the meeting and recommended further review with the county attorney if a federal purchase or proposal materializes.
