Council president wins amendment to prioritize local park for Viva White Oak, ties delivery to later bond series

Council President Fannie Gonzalez successfully offered an amendment to the Viva White Oak resolution to prioritize delivery of a promised local park and to make clear that park costs should not become a county CIP burden. Gonzalez framed the amendment as protecting future residents and preserving the county’s practice of requiring developers to provide public amenities: "They should not go in the C I P. This developers should not get a break," she said.

Vice President Balcom proposed a friendly revision that focuses the amendment on evaluating the feasibility of financing the local park through the district and links the park’s construction timing to the "second bond issuance" (later codified as Series B in technical drafting). County planning staff told the committee the planning board required a local park and that timing could align with the later bond series; county attorneys and finance staff said they would refine the wording with council staff and legal counsel before final action.

The committee accepted the amended amendment and voted unanimously. Legal staff noted a distinction between a policy statement in a council resolution and enforceable contractual requirements: additional tools (GDA amendments, inclusion of the park in Exhibit C as a TIF-eligible project, or permitting holdbacks) would be necessary to compel a particular funding source or to bar future CIP funding by later councils. The committee recorded the language and requested technical edits to ensure the reference to the second bond issuance is consistent with bond-series tables in the fiscal packet.
