Sen. Johnson: committee substitute for SB 2557 would expand registration to "nicotine-adjacent" and closed systems

Senator Johnson introduced Senate Bill 2557’s committee substitute and said the amendment would add a definition for "nicotine-adjacent products" to capture synthetic products that have nicotine-like effects and are being used to evade the Department of Revenue registration requirement. "The gist of it is that it is capturing the definition of nicotine adjacent products ... that are being used to skirt the current registration system," he said.
Johnson told the committee the substitute would also add language to cover "closed systems," meaning devices that come pre-wrapped or prefilled with nicotine that cannot be altered by the user. "We would add in a closed system," he said, describing the difference between insertable cartridges and pre-wrapped products. He answered a clarifying question from Senator Wiggins that the change is intended to ensure these products are captured, not to remove products from the existing registration scheme. The committee approved the committee substitute and will report it to the floor for further consideration.
