Senator Sparks described Senate Bill 2336 as an expansion of expungement options for people who were victims of human trafficking. The bill would add certain offenses to a list of nonexpungible felonies and, at the same time, allow trafficking victims to apply for expungement of qualifying offenses committed while they were being trafficked.
Sparks said the bill covers situations where criminal liability resulted directly from trafficking and would permit the court to expunge without the usual timelines; he emphasized that the bill uses a 'may expunge' standard rather than an automatic expungement. The committee voted 'title sufficient' and moved the bill forward.
