Plan Commission approves sidewalk waiver for Gentry East Phase 3

The Monroe County Plan Commission on July 21 approved a primary plat amendment and granted a sidewalk waiver and waiver of the final hearing for Gentry East Phase 3 (SPP-26-3) by a 7-0 vote.
Staff presented the request as a primary plat amendment affecting one lot of record (0.46 acres) at 1017 South Hillside Court in Perry Township, part of the Gentry East planned unit development. A staff member said the parcel is recorded in county files as Lot 105 (though earlier maps also show it as Lot 102) and described the project history: the original developer failed to complete required improvements and later went bankrupt, leaving infrastructure responsibilities with the homeowners association. Staff recommended approval based on highway engineer and stormwater program manager findings. The presenter summarized: “This is a planned unit development called Gentry East” and described the maps, photos and staff findings supporting a sidewalk waiver.
Rita Klingelhoeffer, president and treasurer of the Gentry East Homeowners Association, told the commission the HOA has spent about four years organizing to finish infrastructure and that four of the neighborhood’s six sections already are in the county inventory. Klingelhoeffer said the HOA’s dues are $240 per lot (about $50,000 annually) and that the association has collected roughly 97% of needed funds to date; she said homeowners preferred not to have a sidewalk routed through yards with mature trees. “We have been working diligently over the last, probably four years to get everything in order,” Klingelhoeffer said.
A resident, Bennett Tate, voiced support during the public hearing, saying he has lived in Gentry East 14 years and that he had “never seen an issue with there not being a sidewalk there.”
During staff comments the presenter relayed engineering input that a manhole located within the right-of-way would prevent installing a compliant ADA sidewalk in that exact location; the county’s new highway engineer, Tim Lawson, reviewed the proposal and had no objections to the waiver, the presenter reported. The stormwater program manager and drainage board records from prior approvals were also described as not affected by the amendment.
A commissioner moved to approve SPP-26-3, a motion that passed on a recorded roll call, with the Chair noting that the Plan Commission’s approval does not go forward to the county commissioners. The vote was recorded as unanimous in favor.
