"If there are any refunds, overcharges that they find, they get 33 and 0.333 percent of whatever that refund is," a staff presenter said while explaining the contingency structure. Staff emphasized that the city could accept or reject findings and that rejecting a finding could limit direct city contact with utilities for 30 months as described in the agreement. Council voted to authorize the agreement and to allow the city manager or finance director to execute the contract.
