The Apache Junction Unified School District governing board voted to convene an executive session on July 24 to consult with the district’s attorneys about the district’s position on an intergovernmental agreement with the East Valley Institute of Technology.
The chair introduced Action Item 2.1 and read the statutory basis: Arizona Revised Statutes §38-431.03(A)(3) and (A)(4), allowing the board to receive legal advice and to consider and instruct its attorneys. A board member moved for executive session, the motion was seconded and the board approved it by voice vote, recorded as 5 to 0.
Board members returned to public session and, following a public briefing, took action to approve the IGA and to delegate authority to the superintendent to execute the agreement consistent with the instructions provided to counsel in the executive session. The board noted that attorneys may appear in person, virtually or by telephone for the executive session; no substantive details of the closed session were disclosed on the public record.
