The stipulation (admitted by the owner except for two limited allegations about patrons and a particular receipt claim) included that officers found no licensed operator on duty during the visits, there was evidence the tavern never commenced business after issuance (no inventory, no invoices), and interior doors between the convenience store and the tavern were not secured, allowing police entry.
City attorney Stan and attorney David Halbrooks explained that the city's ordinance and state statute provide grounds for revocation under these circumstances. Halbrooks told the council the owners had since recruited staff and a manager and asked for a short period (30 days) to remedy the deficiencies, but multiple aldermen said the record and the owner's prior interactions gave them concern. The council voted to revoke the two licenses by roll call. Stan noted the ordinance also allows applicants to seek reissuance after a prescribed period.
