Council authorizes telecommunications franchise for Zayo Group, LLC

The Midvale City Council on April 1 voted unanimously to authorize Mayor Dustin Gettel to execute a telecommunications franchise agreement with Zayo Group, LLC under Resolution No. 2025‑R‑15.
Aubrey Ruiz explained that Midvale Municipal Code Chapter 5.52 requires companies providing telecommunications to obtain a franchise before operating in the City's right‑of‑way. "Zayo Group, LLC has submitted complete applications and did not request changes to the City's standard franchise language," Ruiz said. The franchise will permit Zayo to install fiber‑optic lines and will generate franchise revenue for Midvale through right‑of‑way access and pole attachments.
Council Member Bryant Brown asked if the process could be expedited in the future; City Attorney Garrett Wilcox said the ordinance could be amended to allow an expedited administrative approval process while preserving Council oversight when substantive changes are requested. The resolution passed on a roll‑call vote with Council Members Billings, Glover, Robinson, Brown and Mikolash voting Aye.
The franchise follows terms materially the same as previous agreements the City executed with other infrastructure providers and does not alter the City's insurance or bonding requirements for telecommunications in the public right‑of‑way.
