Council approves duplex-overlay zoning amendment, allowing individual ownership of duplex units

The Midvale City Council on April 15 approved Ordinance No. 2025-O-05, a text amendment to the city’s zoning code that clarifies the duplex overlay zone and amends the duplex definition to allow individual ownership of each side of a duplex. Senior Planner Elizabeth Arnold told the council the changes “remove redundant language” and make the ordinance easier to interpret.
The proposal also removes a requirement that a structure be preexisting before it can be subdivided into duplex units, which staff said aligns the code with current development expectations. The council opened and closed the public comment period with no speakers and voted to approve the ordinance. Council Member Heidi Robinson offered the motion to approve, which passed on a roll-call vote with Council Members Bonnie Billings, Paul Glover, Heidi Robinson, and Denece Mikolash voting Aye and Council Member Bryant Brown absent.
Supporters said the change will permit more flexible property ownership arrangements for duplexes; staff characterized the edits as clarifying and corrective rather than policy changes. The amendment was processed under Midvale City Code 17-3-1(F) as a clarification of language and intent.
