The Borough of Old Tappan Planning Board approved a variance allowing applicant Gladman to roof about 600 square feet of an existing backyard patio, subject to explicit conditions that limit enclosure and utilities. The board recorded conditions on the approval: the covered area must remain open-air without permanent walls (only retractable screens allowed), and no heating or air-conditioning may be installed.
Applicant Gladman told the board the project would be an extension of an existing patio to create “a more comfortable environment for me and my family,” describing an outdoor kitchen and fireplace while stressing the space would remain open. Board counsel explained that the new 600-square-foot roof counts as new floor area and therefore triggers a d4 use variance, but said the board may consider the site’s specific constraints in weighing relief.
Neighbors were given an opportunity to speak; abutting property owner Jason Fox said he had no objection and did not expect his lake view to be affected. Following questions about drainage, lot coverage and retractable screening, the board moved to approve the application with the conditions read into the record: no permanent enclosure, only retractable screens allowed, and no heating or central air. Chair (S6) said, “I don't like the application, but I'm gonna vote in favor of it.”
In roll-call-style confirmation, several members answered in the affirmative when polled by name, including Mister Ellis, Mister Chastava, Mister Dehayen, Mister Nazarian and Mister Kramer; the motion carried. The board asked staff to memorialize the existing lot-coverage nonconformity in the approval record so future owners are aware of the condition.
