Commission adopts ordinance to regulate certified recovery residences and administrators
Summary
Following state law changes, the commission adopted Ordinance 76-25 creating local land-development review and credentialing requirements for certified recovery residences, including administrator credentialing and reasonable-accommodation processes; vote was 4–1 (mayor opposed).
The commission adopted Ordinance 76-25 to implement state requirements from SB 954 and to establish a city process for reviewing certified recovery residences. Planning staff explained the ordinance adds definitions, occupancy and community-compatibility criteria, minimum distances between recovery residences, ongoing compliance rules and a credential requirement for recovery-residence administrators.
City attorney and planning staff said state regulation requires credentialing (via the Department of Children and Families or an approved credentialing entity) and that administrators must be on site as part of the proposed local framework. Planning staff recommended approval to ensure the city is compliant with state statute and able to review reasonable-accommodation requests.
During the public hearing staff and commissioners discussed that the city is aware of roughly two such residences previously in town; there were no new applications before the commission. The ordinance passed on second reading by roll call vote, 4–1, with Mayor Freddie Cleveland voting no.
