Code board continues Maryland Avenue case while permit remains under review

The New Smyrna Beach Code Compliance Board on Feb. 19 continued a case involving the property listed under CCB04652025809 on Maryland Avenue after staff said the property’s permit remains in review.
Staff reported that the board’s prior order (dated Nov. 20, 2025) was served and that a follow-up inspection on Feb. 19, 2026 showed the permit status as still “in review.” Staff said the planning department expects the matter to be considered by the City Commission and recommended continuing the case to the April hearing to allow the license-agreement process to proceed. “It is my recommendation that the board continue this case until probably the April hearing,” the presenter said.
Board members voted to accept the staff recommendation and continue the matter to the next hearing so the city can process the pending license agreement and permit application. The board instructed respondents to contact the code inspector to verify compliance and reminded them of a 30-day right to appeal when the order is issued.
The continuation preserves the board’s ability to impose fines later if the permit is not approved; staff indicated the planning department is aiming to place the item on the March 10 City Commission agenda and then return the case for review in April.
