The Town of Selma Town Council voted to send a package of ordinance updates to staff after Chair outlined a set of state-driven changes the town must mirror. Chair said municipalities "cannot specify a minimum amount of parking spaces required at these establishments," referring to a new statutory prohibition on local minimum parking requirements for new construction.
Council also agreed to remove references to misdemeanor charges in Chapter 17 of the town code at the state's direction and to update the definition of family care homes to match recently changed state language. Chair noted the town's current 180-day vacancy rule for nonconforming uses will be changed to a 24-month vacancy period to comply with general statute requirements. "So that is going to need to be changed in our ordinance as well," the Chair said during the discussion.
Staff will prepare revised ordinance language for the planning board's August meeting and a town-council public hearing anticipated in September. The council emphasized the changes are mandatory because they derive from the North Carolina General Assembly and asked staff to bring clear draft language that reflects the statutory citations discussed in the meeting.
