The item was continued after applicant Matthew Hoover handed his only copy of lease agreements to Zoning Officer Ryan Wessner for review; copies were made at the meeting.
Commissioner Fritz Najarian said the Rosetree manure‑management documents may have been prepared without proof of the leased acreage and referenced Act 38 requirements that land be under full control of the agricultural operation. Solicitor Marc Fisher and Zoning Officer Ryan Wessner requested a single clear document showing which property is included in the manure plans; Eric Rosenbaum of Rosetree Consulting said the newest plan for 7566 Blue Mountain House Road contains that information. LCCD’s review result of David Hoover’s Act 38 submission is expected in September 2026, and Township Engineer Karl Scherzberg reminded the applicant that ten complete copies of plan sets must be submitted for an official Township filing.
Fritz Najarian moved to table the feasibility review until the zoning determination can be made from the newly provided lease paperwork; Larry Bachman seconded and the motion carried with no opposition. The commission left the item pending the solicitor’s review of leases and the zoning officer’s verification of the revised plan materials.
