Attorney Sara Senica told the Village of Michiana council the village's appeal in its dispute with New Buffalo Township was denied by the Michigan appellate court.
"The Michigan Court of Appeals denied hearing the village's appeal," Senica said, and she told the council that the Michigan Municipal League (MML) board had discussed a possible legislative amendment and that she would keep the council informed if there were developments. The council did not take further formal action in open session on the lawsuit.
Senica framed the denial as a legal setback while noting a potential next step through legislative routes. Council members did not vote on additional legal spending during the meeting; the matter was handled as an update under old business. The council later entered a closed session under the Michigan Open Meetings Act to consider an attorney-client letter, as listed on the agenda.
Next steps: Senica said she would notify the council if the MML or other parties pursue legislative changes that could affect the village's position.
