Council passes first reading of flood ordinance housekeeping item already in Florida Building Code
Summary
Ord. No. 163, which the town attorney said duplicates provisions already in the Florida Building Code, passed first reading 4-0. The attorney advised the provisions were unnecessary in the town ordinance but the council passed the ordinance on first reading.
On Nov. 14 the Cloud Lake Town Council passed Ordinance No. 163 on first reading, amending Chapter 4 of the Flood Damage Prevention Ordinance. Town Attorney William P. Doney read the ordinance by title and said the provisions are redundant because they are already addressed by the Florida Building Code. Council Member Alexandra Powell-Sardinas moved to pass Ord. No. 163 on first reading; Council Member Kathleen Hoock seconded and the motion passed 4-0 with Council Member John Tyson absent.
The minutes record the attorney's view that the ordinance language is unnecessary given state code coverage. The ordinance nevertheless proceeded on first reading and will follow subsequent adoption procedures if required by town code.
