Commission backs zoning text amendment to align setback exceptions with state law

Midvale City Planning staff asked the commission May 13 to recommend a text amendment to Title 17 of the Midvale Municipal Code that would modify residential rear setback exceptions to conform with changes in Utah law (House Bill 476, codified under UCA 10-9a-540 and renumbered 10-20-623 on Nov. 6, 2025). Staff said the amendment would also clarify how the International Residential and Building Codes apply to window wells and setback interpretation.
Planner Jonathan Anderson and Planning Director Wendelin Knobloch explained the amendment’s purpose: to align local code with the governing state statute, remove ambiguities in the existing language, and identify which sections of Title 17 are affected. Staff recommended the Planning Commission forward the amendment to City Council with a finding that it complies with Midvale City Code 17-3-1(F) criteria.
Commissioners asked whether current projects might already meet the modified setback allowances and whether the change stemmed from a clerical or policy-driven need; staff responded the change primarily implements state law and aims to make the code easier to interpret. Commissioner Dustin Snow asked about the scope and practical effect; staff said the amendment updates every applicable section of Title 17 and includes clarifying language rather than substantive local policy shifts beyond conforming to state requirements.
Commissioner Robyn Anderson moved and Vice Chair Shane Liedtke seconded a motion to recommend approval; the commission voted unanimously (5–0) to forward the text amendment to City Council.
