Port Jeffersons Zoning Board of Appeals on July 23 heard a presentation for a proposed 4‑story, 16‑unit residential building at 116 Oakland Avenue and voted to hold the hearing open until the Planning Board completes State Environmental Quality Review (SEQRA). Dan Gross, planning staff, told the board the project is a Type I action because it exceeds 35 feet in height and contains more than 15 units, and that “the zoning board can't technically act on this application until SEQRA is complete.”
Applicant representatives and the property owner described the proposal as a demolition of a one‑story commercial building and construction of a new multi‑family building with 1.7‑foot side setbacks on the north and south where the C2 PO overlay requires 8 feet. Mike Grant of North Coast Civil, presenting for the owner, said the design "fits within the property nicely" and described the setback variances as "de minimis in nature." Chair (Speaker 1) and several board members voiced concern about neighborhood compatibility and the timing of the ZBAs action relative to the Planning Boards lead agency determination.
The board voted to keep the hearing open and return the matter to the ZBAs September meeting, currently set for September 24, allowing time for the Planning Board to complete SEQRA coordination. The applicant will pursue required Planning Board actions including payment‑in‑lieu for four parking spaces and SEQRA materials before the ZBA considers final action.
