Elkton Town Council certifies closed meeting compliance, records 5–0 votes

After recessing into Closed Session, the Elkton Town Council returned to Regular Session and moved to certify the Closed Meeting as compliant with Virginia’s Open Meeting Act. Council member Virginia Fulginiti moved, with a second from Council member Rachel Michael, that the Council certify pursuant to Virginia Code § 2.2-3712(D) that, to the best of each member’s knowledge, only matters lawfully exempted under Virginia Code § 2.2-3711 were discussed in the Closed Meeting and that each member’s vote be recorded in the minutes.
The motion to certify passed by voice vote with five members recorded as voting in favor: J. Hensley, V. Fulginiti, R. Michael, A. Napotnik and L. Heidel; no members voted against the motion (vote recorded as 5 – 0). The minutes also note that Vice‑Mayor Rick Workman arrived at 4:02 p.m. after the Council had already convened in Closed Session and left before the certification motion, and therefore was not included in the recorded vote. With no additional business, the Council adjourned. The minutes were signed by Mayor Joshua J. Gooden and Clerk Denise R. Monger.
