Council approves settlement agreement and authorizes mayor to sign after brief executive session

City Attorney Joanna summarized a pending appeal of permits for a mixed-use project by QMC (referred to as Cortera in the report) and said three parties had filed appeals; two appeals were dismissed and the remaining appeal by neighbor David Grampa remained unresolved. Joanna reported that QMC, Cortera and Grampa reached a settlement and "both have signed the agreement," and that staff and the city attorney had reviewed the agreement and found the items the parties agreed to "are still within the scope of the original permits as issued to QMC." She stated that the terms are "none of which are monetary, on the part of the city."
Council then entered an executive session under RCW 42.31.110(1)(i) to consult with legal counsel about litigation; after a 10-minute session the council returned and moved to approve Resolution 1883 authorizing the mayor to execute the settlement agreement; the motion passed by voice vote.
