County declines to accept sole ownership in CDOT MOU for Bradfield Bridge; asks to be copied on inspections

The board reviewed a draft MOU from the Colorado Department of Transportation that appeared to list Dolores County as the owner of Bradfield Bridge. County Attorney Dennis cautioned that accepting the MOU as written could make the county solely responsible for future bridge repairs and potentially expose it to substantial costs. "I don't think we have a 100% clear picture of that," Dennis said, advising that the county should reserve flexibility and not accept an allocation of sole responsibility at this time.
Dennis recommended responding that the county is unwilling to enter into an allocation of responsibility at present but asked to be copied on CDOT's inspection reports so the county can remain informed. Commissioners directed staff to draft a 'heads up' letter with that language and to copy the Bureau of Reclamation and other stakeholders who supplied inspection information. No transfer of ownership or formal acceptance of responsibility was made at the meeting.
