County adopts updated state on-site wastewater rules after public hearing

The Lawrence County Board adopted resolution O4-26-O2 to take the state's revised Regulation 43 on on-site wastewater treatment systems into local effect. Commissioners and staff discussed only a few substantive local differences. Chair (speaker 3) and staff noted the county has repeatedly opted not to require title-transfer inspections and instead requires applicants to hire an engineer to design or certify systems; speaker 4 said the county's current system of engineer-hired reviews "has worked out extremely well." Commissioners also noted the revised rule did not add a clear statewide definition of "dwelling," which leaves the county to determine on a case-by-case basis whether certain living arrangements (for example, an RV on blocks) qualify as a dwelling for wastewater requirements. The panel voted to adopt the resolution; staff recorded that, by statute, the regulation will be effective 45 days from the date of adoption.
