Permit for Arizona Holdings project stalled after company failed to post required performance bond, town official says

A planning-board official told the Hurley board that the building permit issued to Arizona Holdings included a required performance bond with the town as grantee, but the applicant has not executed it. "They have failed to actually execute that and have been working on ways to sidestep that requirement," the planning-board official said, adding that the town cannot accept substitute measures in place of the bond.
The board has engaged engineer Bruce Sutter of Vartorius to validate the appropriate bond amount for the project, the official said, and the permit renewal process — done annually, the official said — does not remove the requirement. "Nothing's gonna happen until this performance bond is issued," the planning-board official said. The planning board is overseeing the effort and will not clear construction to proceed until the bond issue is resolved.
Board members and speakers raised resident concerns that the site has not improved and urged the town to enforce permit conditions. The planning-board official described the town's current position: the bond is a permit condition and remains outstanding; the applicant has not provided sufficient information to the town's engineer to validate alternatives.
