Staff reported the townhouse portion of the project is operating on a temporary certificate of occupancy; a small landscaping bond refund request was granted but a larger development bond tied to the development agreement has not been released or requested by the developer.
The borough reported it has asked the developer's engineer to certify that paving work meets the approved plans and industry standards and has reserved its rights under the development agreement. "The larger bond has not been requested," an engineer told the council, and borough staff said they will press for the engineer's certification prior to issuing full acceptance or final COs.
