Developer asks borough to reimburse $3,333 sidewalk contribution for 19 Deerborn

A developer and one of the LLC members for a project at 19 Deerborn requested reimbursement of a previously paid sidewalk-in-lieu contribution of $3,333 after deciding to replace the entire sidewalk at their expense.
"We paid into the sidewalk contribution fund $3,333 ... we have decided to replace the sidewalk in its entirety ... so we just wanted to bring it up to consideration if we can possibly get a reimbursement of that $3,333," developer Daniel Ebar said. Engineer Tom Scrabble reviewed the ordinance language and said the mayor and council have the authority to refund a previously paid contribution where the developer instead constructs the sidewalk. Council members expressed support and asked Tom to review the work; the project team was told the council would draft a resolution to reimburse the contribution once the engineer confirms the work is done to the borough's satisfaction.
Council directed staff to prepare language and memorialize the agreement at the next meeting.
