City Attorney Garrett Wilcox told the council that staff identified procedural shortcomings in Chapter 7.04 related to emergency abatements after responding to an imminent life-safety issue. Wilcox explained that due process requires notice, an opportunity to be heard, and a neutral decision-maker, and that the code currently did not require notice to affected persons.
The adopted Ordinance No. 2026-O-01 adds notice requirements and ensures affected people are informed of their right to request a hearing before the hearing officer. Council Member Bonnie Billings moved to adopt the ordinance; the motion was seconded and passed unanimously with the five council members voting Aye.
