Kate Langworthy, staff attorney supporting the Department of Agriculture's Division of Animal Health, presented a package of amendments to KAR 9-3 intended to update definitions, recordkeeping, testing and herd-status protocols for domesticated cervid operations. "These changes were requested by industry and were developed with their input so that the resulting regulations reflect current management practices and standards of the surveyed industry while still meeting requirements for participation in the CWD HCP," Langworthy told the committee. A public hearing is scheduled for 05/06/2026.
Langworthy walked through definitions added in KAR 9-3-6 (antemortem CWD test, domesticated-cervid movement notification, trace-back/trace-forward herd concepts), fee and permit clarifications, and revisions allowing alternative testing modalities for program compliance. Justin Smith, the state animal health commissioner, told the committee the CWD program in Kansas is voluntary and covers susceptible species including deer and elk. Representative Corbett confirmed the rules target domesticated cervid operations rather than wild-game production or birds; Langworthy said there are no bird implications in this package.
