Council approves vacation of Berkey Drive right-of-way adjacent to City Center lots

The Box Elder City Council on April 10 approved Resolution No. 26-13 to vacate the Berkey Drive right-of-way adjacent to Lots 9R2A and 9R2B of the City Center Subdivision. Laurie Patton, the city planning director, told the council the vacation applies to the lot south of the Pizza Hut and that the property owner has agreed to keep a trail easement across the site.
"This is a vacation to vacate the right of way, basically, on the lot that is south of Pizza Hut," Patton said during the public hearing and noted an earlier proposal to connect Berkey Drive through the Children’s Museum lot has been shelved. Councilor Davis moved to approve the resolution and Councilor Knight seconded; a roll-call vote recorded all members voting aye and the motion passed.
Patton said the accompanying minor plat (later considered on the agenda) had been revised to correct labeling and to reflect the retained easement. The council’s action completes the local land-use approvals associated with the petition to vacate; no appeals or remonstrances were recorded in the meeting record.
