Committee sets rulemaking schedule to allow grant agreements after July 1 effective date

Committee staff explained the legal sequencing that rules must be exposed and adopted before the board can formally adopt a grant agreement that obligates state funds. "We cannot get to a place where the board can adopt a grant agreement until the rules are actually finalized to provide the framework for the grant agreement," Martin Piccione said, stressing that rules provide the legal framework and public notice necessary before funds can be disbursed.
Members agreed to target the June 5 board packet to expose draft rules, run a public comment process over the summer, and plan for a September board discussion with a possible October 1 rules effective date. Piccione and Melise Cunningham (DOJ) emphasized the Foundation can prepare an in-principle agreement before rules are final but should not execute or disburse funds until both the statute and rules are effective.
