Board authorizes OSCPA and executive director to seek friendly amendment to SB 797

The board considered a proposed 'friendly amendment' to Senate Bill 797 that would clarify statutory mobility and substantial-equivalency language and fix an edge-case that could leave a small subset of applicants without mobility rights. Counsel explained four possible fix options (ranging from minimalist to more expansive language) and members discussed trade-offs between clarity and legislative pushback.
"This is just a mobility issue for a very small subsection of folks," counsel said, describing the risk of unintended consequences for an applicant whose original licensing jurisdiction did not require certain education/experience combinations. Several members urged starting with the most corrective language but remaining prepared to step down to a less ambitious option if drafting or legislative pushback made it necessary.
Jason Robinson moved to allow OSCPA, the executive director and staff to pursue a friendly amendment consistent with the memo outlining options; the motion was seconded and passed by roll-call vote. Chair Hailey Lyons called the motion passed after votes from Hailey Lyons, Raul Valdivia, Megan Hartley, Logan Seale, Jason Robinson and Joe Sullivan.
What comes next: staff will work with OSCPA to draft a request, seek legislative sponsorship and return any drafted amendment to the chair and counsel for an analysis of whether it delivers the board's intent. If the legislature or counsel suggests changes, staff will report back for further direction.
