Committee hears HB525 on mandatory minimums for sexual battery offenses; bill tabled

Senator Sparks explained that House Bill 525 would add a mandatory minimum of five years for certain convictions of sexual battery when the victim is under 16, with increased minimums for repeat offenses. "That does not, I don't believe, raise the maximum, but it does input a not less than 5 years, and then on a 2nd offense, not less than 10 years," he told the committee.
Committee members asked whether the bill changes existing maximum penalties and whether it responds to particular cases or prosecutorial concerns. The sponsor said the bill adds a floor and that he had not been personally contacted by prosecutors' associations but was handling the bill on behalf of house sponsors. Given the absence of the primary sponsor and outstanding questions, a motion was made and the committee voted to table the bill subject to call so Representative Remac could return to answer remaining concerns.
