Planning board reapproves Greenvest subdivision, waives sidewalk contribution

The Monroe Township Planning Board on July 23 reapproved a minor subdivision for Greenvest LLC and waived a cash-in-lieu contribution and curb-and-sidewalk installation that had been included in an earlier resolution.

Frank Wisniewski, attorney for Greenvest, told the board the applicant missed the statutory filing window and asked the board to reapprove the subdivision so deeds could be filed. "So we are requesting that the board reapprove the subdivision and then we can go ahead and file the deeds," Wisniewski said. He also asked the board to waive a cash contribution that had mistakenly remained in the written resolution.

Board members and the board attorney said the application is a lot-line adjustment and that the underlying parcel is subject to a conservation easement, meaning no new houses will be built there. One board member described the proposal as a cleanup of encroachments for a small number of homes on Hoffman Road and said, "there will never be a house on this property... it's in a conservation easement," supporting the requested waivers.

Counsel advised that deviations from code requirements may be justified when a property’s unique circumstances support relief, and the board proceeded with a motion and second to reapprove the subdivision and waive the contribution and curb/sidewalk requirement. The roll-call vote approved the memorialization and the waivers; the board then moved on to other agenda items.

Next steps: the reapproval allows Greenvest to file deeds and work with the township attorney and engineer on form documents.
